Virtual Items
Our games may include digital content such as in-game currencies, boosters, or other Virtual Items that enhance gameplay. These items exist solely within the Services and have no monetary value outside the game. You acknowledge that Virtual Items are non-transferable, non-exchangeable, and non-refundable, except where required by applicable law or platform policies (Apple App Store, Google Play).
You do not own Virtual Items; instead, you receive a limited, revocable license to use them as part of the Services. SuperDuck reserves the right to modify, suspend, or discontinue Virtual Items at any time, including changing their availability, pricing, or functionality. We may also adjust balances to maintain fair play and game integrity. Virtual Items cannot be sold, traded, or converted into real-world currency. Any attempt to do so may result in account suspension or termination. For players in the EU and UK, statutory consumer rights under the Digital Content Directive apply and remain unaffected by these Terms.
User Rules
To maintain a safe, fair, and enjoyable community, you agree to comply with the following rules when using our Services:
Do not cheat, exploit bugs, or use bots, hacks, or third-party tools.
Do not harass, bully, impersonate others, or spread hate speech or symbols.
Do not upload or share illegal, infringing, obscene, or harmful content.
Do not attempt to sell, trade, or transfer accounts, Virtual Items, or access rights.
Do not engage in unauthorized commercial activity using our Services.
Violation of these rules may lead to warnings, temporary suspension, or permanent termination of your account. We reserve the right to enforce these rules at our discretion, considering the severity and frequency of violations. Players are encouraged to report misconduct using in-game reporting tools or by contacting support. These User Rules exist to ensure fairness, protect our community, and preserve the integrity of gameplay. By agreeing to these Terms, you accept full responsibility for following these rules and understanding that violations may have consequences.
Content Moderation
We are committed to fostering a safe and respectful environment for all players. To achieve this, we monitor content shared through our Services and reserve the right to moderate, remove, or restrict access to content that we determine violates these Terms, infringes intellectual property rights, or poses risks to users or the integrity of our games. This may include user names, chat messages, forum posts, Discord contributions, or any other content generated by users. While we do not actively monitor every piece of content in real time, we employ both automated tools and manual review to detect and respond to harmful activity. We also encourage players to report inappropriate content or behavior. Reports are reviewed promptly, and actions may range from issuing warnings to suspending or permanently banning accounts. By using our Services, you acknowledge and agree that content moderation is necessary to maintain a healthy community. You also understand that we may preserve and disclose information when legally required to do so.
DMCA Notice & Takedown
SuperDuck respects intellectual property rights and expects users to do the same. If you believe your copyrighted work has been copied, distributed, or displayed within our Services without authorization, you may submit a Digital Millennium Copyright Act (DMCA) notice to us at info@superduckgames.com
Your notice must include:
(a) a description of the copyrighted work you claim is infringed;
(b) the location in the Services where the material is found;
(c) your contact information;
(d) a statement that you believe in good faith the use is not authorized;
(e) a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and
(f) your electronic or physical signature.
Upon receiving a valid notice, we may remove or disable access to the content, and in cases of repeated infringement, terminate the user’s account. Please be aware that submitting false claims may expose you to legal liability, so only file a DMCA request if you have a legitimate basis.
Purchases, Billing & Subscriptions
Some features of our Services may require payment, including Virtual Items, premium content, or subscription services. Purchases are processed through third-party platforms such as Apple App Store or Google Play. By making a purchase, you agree to their terms and conditions in addition to ours. Prices may vary by region and are subject to change without notice. Subscription services may automatically renew at the end of each billing cycle unless you cancel them at least 24 hours before the renewal date, following the procedures set by your platform provider. Refunds are provided only where required by applicable law or platform policy; SuperDuck itself does not directly issue refunds for transactions made through Apple or Google. It is your responsibility to review and manage your purchases, subscriptions, and payment settings. Unauthorized purchases made through your account remain your responsibility, so please safeguard your account credentials carefully. We may offer promotional pricing or discounts from time to time, but these are limited offers and subject to specific conditions.
Third-Party Links & Ads
Our Services may contain advertisements, promotions, or links to websites and services operated by third parties. These third-party resources are provided for convenience only, and we do not endorse, control, or assume responsibility for their content, policies, or practices. When you engage with a third-party ad, click a link, or download software, you do so at your own risk. Your interactions with third parties, including advertisers and partners, are solely between you and those entities. They may collect personal data, track your behavior, or require you to accept their own terms and privacy policies. We encourage you to read those policies carefully before proceeding. SuperDuck is not liable for any damage, loss, or issues that result from your dealings with third parties, including payment disputes, data breaches, or misleading advertisements. Advertising revenue may support our Services, but it does not change your obligations under these Terms. If you see problematic ads or links, please report them so we can investigate.
Governing Law – EEA/UK Users
If you reside in the European Economic Area (EEA) or the United Kingdom, these Terms and your use of the Services are governed by the laws of Türkiye, without prejudice to any mandatory consumer protection laws of your country of residence. This means that while Turkish law provides the legal framework, you retain the benefit of your local legal protections. Disputes may be brought before the courts of Istanbul, Türkiye, or alternatively before your local small-claims or consumer courts if jurisdiction permits. Nothing in these Terms affects your right to rely on applicable statutory rights under EU or UK consumer protection, digital content, or privacy laws. For example, if mandatory provisions of EU/UK law provide you with certain remedies or protections not explicitly covered here, those protections remain available to you. This dual framework ensures that your rights as a consumer are preserved while also providing predictability in how disputes with SuperDuck are handled.
Indemnification
You agree to defend, indemnify, and hold harmless SuperDuck Games Teknoloji A.Ş., its affiliates, directors, officers, employees, agents, licensors, and partners from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your infringement or alleged infringement of any third-party rights, including intellectual property, privacy, or publicity rights; or (d) your unlawful or harmful conduct. This means that if your actions cause harm to us or to others while using our Services, you will be responsible for covering the costs associated with defending and resolving those claims. We reserve the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses. This provision continues even after your account is terminated or you stop using the Services.
