Our Services include mobile and online games on iOS, Android, and web platforms; official websites; community forums; Discord servers; esports tournaments; LiveOps events; and promotional campaigns. Collectively, these are referred to as the “Services.” By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Services immediately. These Terms are legally binding and ensure fairness between you as a user and us as a provider. They also protect the integrity of our games and communities. We may revise these Terms periodically to reflect changes in law, technology, or business practices.

Eligibility / Child Accounts

Our Services are designed for players who are at least 13 years old, or the legal age of digital consent in their jurisdiction. If you are younger than that, you may not use our Services under any circumstances. Players who are between 13 and 17 years of age (or the local age of majority if different) may only use our Services under the supervision and with the consent of a parent or legal guardian. By allowing their child to use our Services, parents and guardians accept full responsibility for monitoring activity, ensuring compliance with these Terms, and safeguarding account credentials. We comply with the Children’s Online Privacy Protection Act (COPPA) and other international laws protecting minors. If we learn that personal data has been collected from a child under 13 without verified parental consent, we will promptly delete such data and may terminate the related account. By creating an account or using our Services, you confirm that you meet the minimum age requirement or have appropriate parental consent.

Accounts & Credentials

To access certain features of our Services, you may be required to register an account by providing accurate, current, and complete information, such as a username, email address, and password. You agree to keep your account details updated at all times. You are solely responsible for safeguarding your login credentials and for all activity that occurs on your account. If you suspect unauthorized use or any breach of security, you must notify us immediately through the support channels provided. SuperDuck is not liable for any losses or damages arising from unauthorized account use if you fail to follow these security obligations. We may reclaim usernames that are inactive, infringe intellectual property rights, or contain offensive or misleading content. Additionally, accounts that remain inactive for extended periods may be suspended or archived. We strongly recommend that you do not share your account with others, as doing so may compromise your data, progress, or purchases. It is your responsibility to maintain both the accuracy and security of your account information.

Accounts & Credentials

Virtual Items

Our games may include digital content such as in-game currencies, boosters, or other Virtual Items that enhance gameplay. These items exist solely within the Services and have no monetary value outside the game. You acknowledge that Virtual Items are non-transferable, non-exchangeable, and non-refundable, except where required by applicable law or platform policies (Apple App Store, Google Play).

You do not own Virtual Items; instead, you receive a limited, revocable license to use them as part of the Services. SuperDuck reserves the right to modify, suspend, or discontinue Virtual Items at any time, including changing their availability, pricing, or functionality. We may also adjust balances to maintain fair play and game integrity. Virtual Items cannot be sold, traded, or converted into real-world currency. Any attempt to do so may result in account suspension or termination. For players in the EU and UK, statutory consumer rights under the Digital Content Directive apply and remain unaffected by these Terms.

Content Moderation

We are committed to fostering a safe and respectful environment for all players. To achieve this, we monitor content shared through our Services and reserve the right to moderate, remove, or restrict access to content that we determine violates these Terms, infringes intellectual property rights, or poses risks to users or the integrity of our games. This may include user names, chat messages, forum posts, Discord contributions, or any other content generated by users. While we do not actively monitor every piece of content in real time, we employ both automated tools and manual review to detect and respond to harmful activity. We also encourage players to report inappropriate content or behavior. Reports are reviewed promptly, and actions may range from issuing warnings to suspending or permanently banning accounts. By using our Services, you acknowledge and agree that content moderation is necessary to maintain a healthy community. You also understand that we may preserve and disclose information when legally required to do so.

DMCA Notice & Takedown

SuperDuck respects intellectual property rights and expects users to do the same. If you believe your copyrighted work has been copied, distributed, or displayed within our Services without authorization, you may submit a Digital Millennium Copyright Act (DMCA) notice to us at info@superduckgames.com

Your notice must include:
(a) a description of the copyrighted work you claim is infringed;
(b) the location in the Services where the material is found;
(c) your contact information;
(d) a statement that you believe in good faith the use is not authorized;
(e) a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and
(f) your electronic or physical signature.

Upon receiving a valid notice, we may remove or disable access to the content, and in cases of repeated infringement, terminate the user’s account. Please be aware that submitting false claims may expose you to legal liability, so only file a DMCA request if you have a legitimate basis.

User-Generated Content

Our Services may allow you to submit, upload, or share content such as chat messages, forum posts, artwork, screenshots, or other materials (“User-Generated Content”). By providing such content, you grant SuperDuck a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform your content in connection with the Services. This license allows us to operate, improve, and promote our games and communities. You retain ownership of your content but waive any moral rights that may limit our ability to use it. You are responsible for ensuring that your contributions do not violate the rights of others, including copyright, trademark, privacy, or publicity rights. We do not pre-screen every submission, but we reserve the right to remove or refuse content at our discretion. By submitting content, you also acknowledge that we cannot guarantee confidentiality, and you should not share information you consider private or sensitive.

9 Managing Accounts, Ads & Communications

Push Notifications – disable in your device notifications settings or in‑game options.
Emails & SMS – click “unsubscribe” or reply “STOP.”
Cookies & Similar Tech – adjust browser settings or use industry opt‑out tools (DAA/NAI/EDAA). Our websites honour Global Privacy Control (GPC) signals where required.

Purchases, Billing & Subscriptions

Some features of our Services may require payment, including Virtual Items, premium content, or subscription services. Purchases are processed through third-party platforms such as Apple App Store or Google Play. By making a purchase, you agree to their terms and conditions in addition to ours. Prices may vary by region and are subject to change without notice. Subscription services may automatically renew at the end of each billing cycle unless you cancel them at least 24 hours before the renewal date, following the procedures set by your platform provider. Refunds are provided only where required by applicable law or platform policy; SuperDuck itself does not directly issue refunds for transactions made through Apple or Google. It is your responsibility to review and manage your purchases, subscriptions, and payment settings. Unauthorized purchases made through your account remain your responsibility, so please safeguard your account credentials carefully. We may offer promotional pricing or discounts from time to time, but these are limited offers and subject to specific conditions.

Availability, Updates & Beta Tests

We strive to keep our Services available, stable, and enjoyable, but we cannot guarantee uninterrupted access at all times. Maintenance, updates, or technical issues may cause temporary disruptions. We may release patches, upgrades, or new versions that are mandatory for continued use, and you agree to install these updates promptly to ensure proper functionality and security. From time to time, we may also make beta features available. Beta versions are experimental, may contain bugs, and are provided “as is.” Participation in beta testing may be limited and subject to additional rules or agreements. We reserve the right to modify or discontinue any aspect of the Services at any time, including removing features, restricting access, or shutting down servers. While we make reasonable efforts to notify players in advance of significant changes, some circumstances (such as urgent security issues) may require immediate action. By continuing to use our Services, you accept that availability and features may evolve over time.

Availability, Updates & Beta Tests

Third-Party Links & Ads

Our Services may contain advertisements, promotions, or links to websites and services operated by third parties. These third-party resources are provided for convenience only, and we do not endorse, control, or assume responsibility for their content, policies, or practices. When you engage with a third-party ad, click a link, or download software, you do so at your own risk. Your interactions with third parties, including advertisers and partners, are solely between you and those entities. They may collect personal data, track your behavior, or require you to accept their own terms and privacy policies. We encourage you to read those policies carefully before proceeding. SuperDuck is not liable for any damage, loss, or issues that result from your dealings with third parties, including payment disputes, data breaches, or misleading advertisements. Advertising revenue may support our Services, but it does not change your obligations under these Terms. If you see problematic ads or links, please report them so we can investigate.

Photosensitive-Seizure Warning

Our games may contain visual effects such as flashing lights, rapid scene changes, or patterns that could trigger seizures or other adverse health reactions in individuals who are photosensitive. Even players with no history of epilepsy may experience symptoms including dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, or convulsions while viewing certain visual sequences. If you or anyone in your family has a history of epilepsy or other photosensitive conditions, you should consult a doctor before playing. If you experience any symptoms while using the Services, stop immediately and seek medical advice. We also recommend playing in a well-lit environment, taking regular breaks, and sitting at a reasonable distance from the screen to minimize risk. Parents should carefully monitor children during gameplay for any unusual behavior or symptoms. By using our Services, you acknowledge and accept these risks and agree that SuperDuck cannot be held responsible for health-related issues arising from photosensitive content.

Termination & Account Deletion

We reserve the right to suspend, restrict, or permanently terminate your access to the Services if we reasonably believe you have violated these Terms, engaged in unlawful activity, or compromised the safety and integrity of our games or community. Termination may also occur if your account remains inactive for a prolonged period or if required by legal obligations or court orders. Before termination, we may attempt to notify you via the email address linked to your account, but we are not obligated to provide notice in urgent or severe cases, such as cheating, fraud, or harassment. If your account is terminated, you will lose access to any Virtual Items, progress, or subscription benefits associated with that account, and no refunds will be provided except as required by law. You may also request voluntary deletion of your account at any time by contacting our support team or using in-game account management tools. Upon deletion, we will handle your data in accordance with our Privacy Policy.

Disclaimers of Warranties

Our Services are provided strictly on an “as is” and “as available” basis. This means that while we strive to deliver a fun, reliable, and high-quality experience, we cannot guarantee that our Services will always operate without interruption, delay, error, defect, or security breach. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We also do not warrant that the Services will meet your requirements, that your gameplay progress will never be lost, or that issues such as bugs, lag, or incompatibility will not occur. No advice or information, whether oral or written, obtained from SuperDuck or through our Services, creates any warranty not expressly stated here. Certain jurisdictions may not allow the exclusion of specific warranties, in which case some of the above limitations may not apply to you, and your statutory consumer rights remain unaffected.

Disclaimers of Warranties

Limitation of Liability

To the maximum extent permitted by law, SuperDuck, its affiliates, directors, officers, employees, agents, and partners are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Services. This includes, without limitation, damages for lost profits, lost savings, lost data, loss of goodwill, service interruption, device damage, system failure, or costs of substitute services. Our total liability for any claim under these Terms is limited to the greater of: (a) the total amount you have paid to us in the six (6) months preceding the event giving rise to liability, or (b) USD $1000. These limitations apply regardless of the legal theory, whether based on contract, tort, negligence, strict liability, or otherwise. Some jurisdictions may not allow limitations on liability for personal injury, gross negligence, or willful misconduct. In such cases, these limitations apply only to the fullest extent permitted by applicable law.

Limitation of Liability

Mandatory Arbitration & Class-Action Waiver

For users in the United States and other regions outside the EEA/UK where permitted by law, disputes arising from or related to these Terms or the Services must be resolved exclusively through binding arbitration, administered by a recognized arbitration authority. By agreeing to arbitration, both you and SuperDuck waive the right to pursue claims in court, including before a jury, and waive participation in class-action lawsuits, class-wide arbitration, or representative actions. Arbitration is intended to be a faster, less formal way to resolve disputes. However, this clause does not prevent you from bringing small-claims actions in a local court if permitted by law. You have the right to opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending an email to arbitration-optout@superduckgames.com with your full name, account details, and a clear statement of your opt-out request. If you opt out, disputes may be resolved in court as permitted by law. For EEA/UK users, see next section below.

Mandatory Arbitration & Class-Action Waiver

Governing Law – EEA/UK Users

If you reside in the European Economic Area (EEA) or the United Kingdom, these Terms and your use of the Services are governed by the laws of Türkiye, without prejudice to any mandatory consumer protection laws of your country of residence. This means that while Turkish law provides the legal framework, you retain the benefit of your local legal protections. Disputes may be brought before the courts of Istanbul, Türkiye, or alternatively before your local small-claims or consumer courts if jurisdiction permits. Nothing in these Terms affects your right to rely on applicable statutory rights under EU or UK consumer protection, digital content, or privacy laws. For example, if mandatory provisions of EU/UK law provide you with certain remedies or protections not explicitly covered here, those protections remain available to you. This dual framework ensures that your rights as a consumer are preserved while also providing predictability in how disputes with SuperDuck are handled.

Governing Law – U.S./Rest-of-World Users

For all users outside the EEA and UK, these Terms are governed by the laws of Türkiye, without regard to conflict-of-law principles. This means that disputes, controversies, or claims related to the Services will be resolved under Turkish law, except where local mandatory consumer protection laws apply and cannot be waived. Unless you have opted out of arbitration under Section 17, disputes must be resolved through binding arbitration as described above. By using the Services, you acknowledge that Turkish law provides the foundation for these Terms and that you may be subject to arbitration proceedings in accordance with the chosen authority. Some jurisdictions may impose additional consumer rights, refund obligations, or statutory protections; in such cases, those local rights remain unaffected. By accepting these Terms, you agree that legal actions outside the narrow exceptions provided, such as small-claims proceedings, will not be pursued in court but instead through the arbitration framework. This ensures consistent dispute resolution while respecting applicable consumer rights.

Governing Law – U.S./Rest-of-World Users

Indemnification

You agree to defend, indemnify, and hold harmless SuperDuck Games Teknoloji A.Ş., its affiliates, directors, officers, employees, agents, licensors, and partners from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your infringement or alleged infringement of any third-party rights, including intellectual property, privacy, or publicity rights; or (d) your unlawful or harmful conduct. This means that if your actions cause harm to us or to others while using our Services, you will be responsible for covering the costs associated with defending and resolving those claims. We reserve the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses. This provision continues even after your account is terminated or you stop using the Services.

We may revise or update these Terms from time to time in response to changes in laws, regulations, business practices, or technology. When updates occur, we will post the new Terms with a revised “Last Updated” date at the top of this page. Depending on the nature of the changes, we may also provide additional notice through in-game messages, push notifications, or email. Continued use of the Services after such updates means you accept the revised Terms. If you do not agree with the new Terms, you should stop using the Services and, if necessary, request account deletion.
